Trouble is we live in same house, but as im the deaf one and hes got perfect hearing im always using the bone conductor headphones in my room, so it shouldnt be an issue if he has it playing on his phone at night.
The other issue is my mum would be in the same room as him, but her hearing is actually a lot worse than mine so its unlikely it would affect her if ive had this much trouble over last 2 years with the subliminals i dont think it will affect her.
He doesnt believe in subliminals but thought since its just sitting here he might find it useful.

First, I'd like to point out that while you can give away your copy legally, it isn't helping me make money when you do things like that. Second, if you want to give it away, don't expect it to be something you just take back later when it's convenient. If you give it away, you gave it away. And third, if he "doesn't believe in subliminals", why would he even use it?
That said... if you want to give it to him, you must transfer a copy to a device that he owns and tell him that you are giving it to him. Then, immediately delete all copies in your possession, including backups, so that he has the only copy and it is on a device that is definitively his property.
