People could also use them to push counterfeit IML subs, were they to be sold without AP scripting (and, if they're to be used as "filler" after subs, they probably cannot contain it)

The entire point of pushing counterfeit goods is the fact that the buyer does not know it's counterfeit. Conmanship 101.
Right, but if theyre marketed as IML subs then they would know it was not legit? The only place you can buy them is Subliminal Shop, or did you mean another scenario?
They could pretend to be a legitimate re-seller, for example, and try to entice buyers with a ONLY THIS ONE TIME 20% OFF OFFER BUY NOW yadda yadda NLP pseudo-marketing. And then someone who does not perform due diligence before buying - f. in. does not do a cursory Internet search to find the actual IML website - buys a masking track without subliminal content, or with some bullshit subliminal content added in its stead, resulting in loss of reputation for IML and good subliminal programs in the process. Just off the top of my head.
